I tried to enter my SpeedDownload reg details I got on my MacHeist receipt but they won't work in the SD 5 upgrade.
I checked the Yazsoft site and it says:
If you purchased SD 4 between Jan 01, 2008 and Feb 12, 2008, you may upgrade to SD 5 for FREE. Simply email us with your registered SD4 username and email and we will send you your personalized SD5 info.

I have the feeling we won't, as of that weird restriction that you had to download the MH copy and activate it in 6 months...

This is a bad contradiction. As far as I know, there was no explicit exclusion for promo buyers at the moment of purchasing the bundle. And we were said that all licenses were full licenses, with only the restrictions associated to normal licenses.
Hence we should be eligible. If the SD developers state AFTERWARDS that promo buyers are not eligible, then this is a ripoff and Macheist should talk to them.

Does anyone know if so-called "promo purchases" even count for the $15 upgrade offer from version 4 to version 5? It would stink if they force you to pay the whole $25 for it, after we already bought it.

I bought Speed Download as a part of the MacHeist bundle and there were no restrictions listed about upgrading. My registered name is Billy Adams and my register email is billyadams@gmail.com. I was none to pleased to discover that my registration info doesn't work for SD 5. You should know, that I find it very upsetting that the "upgrade" showed up as an "update" in the update stream for SD. I think that is deplorable. If you are going to charge for an updated version, then don't include it in the update stream.

I got the same reply as others. So no free upgrades without a fight. However, at the time of purchase no limitations so therefore we should be given the free upgrade the same way that other SD user that bought it between 1st of January and 12th February are getting it.

Agreed. I know it won't affect their bottom line, but it makes me feel better.
I received an email back as well. The email that I got says that we are eligible for the 15 dollar upgrade, but not the free.
Nothing like getting people to make a purchase and then doing an upgrade a few weeks later.
That's the point of this style of marketing of course.. It just sucks that they were so predatory about it. Nobody likes when their new toy gets old and busted in a few days.
I actually held off on using Speed Download until the past week - I finally decided to give it a shot and now I don't want to be without it. I hate rewarding them with upgrade money so soon.. But I will probably end up doing that..

i got an email from them stating the following:
SD5 is a paid upgrade.
• Please review our upgrade path carefully. Unverifiable upgrades will be de-activated without notice and with no refund.
• SD 4 (regular license) --> SD 5 : $15 per User license.
• SD 4 (double pack) --> SD 5 (double pack): $25 per double pack license.
• SD 4 (five pack) --> SD 5 (five pack): $50 per 5-pack license.• SD 3 --> SD 5 : $20 per User license.
• SD 2 --> SD 5 : $20 per User license.
• SD 1 --> SD 5 : $20 per User license.• Users that have registered SD 5 from Jan 01, 2008 to Feb 12, 2008 can upgrade to SD 5 for FREE.

but on their homepage it states the exact same things they wrote in the email MINUS THE LAST BULLET where they disqualify so called "licenses purchased via promos".
The following picture shows the evidence of that.
We were told it's a license that is just the exact same thing as purchasing the application at the same time from the developers themselves. This is clearly not the case here!

This is really more of a timing concern - If they were smart they'd have delayed until macheist purchases were a couple months old and outside of the free upgrade window.
I did not kid myself when I clicked on buy - I presumed most of the licenses I got would end up being updated to a paid upgrade within 3-6 months - one year at the outside, if ever - honestly a couple of the heist apps I just can't see getting many updates.. I also note that until something happens in the OS which breaks Speed Download 4, I didn't exactly get ripped off, despite the bad tact that yazsoft has taken.
I suspect they did not consider how fickle and venomous this particular group of users can be but I'll be shocked if they budge. Someone there factored all this in

Its is really bad as they have one of the worst licenses so far, Its per USER not computer... so IF I have two macs, I am the same user right?

I've got mail like willwgm3. Well the point is I would gladly purchased the upgrade (or lived without it and kept my mouth shut) if not for few things:
- update showed no warning whatsoever about license termination
- I checked upgrade page and concluded as we were told we are getting full versions (not restricted promo versions) that we qualify for free upgrade
- only after the upgrade was done we get to know that we will not qualify
There were some ways to avoid this confusion eg. "free updates until version 5" (although they probably knew there will be none), or even "MacHeist buyers not qualify for free upgrade " could save a situation a bit.
Anyway, since I'm sure they well knew when will they publish the upgrade before they took part in MacHeist, they should have clearly stated that the licenses are restricted.
The way this is done, the only thing we can see this is as a calculated and cheesy sales tactic

I agreed. This is kinda a bad rep with, let's say, 10,000 unhappy MH bundle purchasers (I assumed that the rest won't care about SD) got upset and 'spreading the word'
They should have released one more 4.x version instead, and then released V5 on April or May

I could understand if this big upgrade was a few more months down the road, but to release an update so soon after the bundle and want to charge seems a bit underhanded. I mean, you include your app in a great bundle, get everyone to like using it (maybe even make it part of their daily routine), and then spring a $15 upgrade fee on them just one month later? Maybe they even figured it was a way to make some more quick money of the MH sales. If nothing else, they obviously knew they'd be releasing v.5 soon after the bundle. I think most people wouldn't have made an issue out of this if the correct warnings had been issued about the upgrade path excluding bundle purchasers. Those who liked the program would have shelled out the 15 bucks.
However it's the false selling aspect of this that upsets me and I suspect others here.
I don't really think we can get them to change their policy just by complaining in numbers - if they rely on these type of tactics to make money I'm not sure I want to be a customer of theirs anyway.
What we can do is let other people know about them via Macupdate, VersionTracker and every other mac tech blog that we can find.
I would also suggest to the Directorate that Yazsoft are not allowed to participate in any future Heists as they seem to be doing the real "heisting"!

Wrong! This is a full Bundle App, even though it was added later in the sale, and it was added without any additional restrictions on its upgrade policy compared to a normal full license.
When I saw this pop up (showed up when I went to download MoodBlast, in fact), I was tempted to purchase the upgrade right away - after all, SD has easily been one of my most-used apps in the Bundle, and I have easily gotten $15 of use out of it that I wouldn't mind paying for the update. But now that I know we should be in the window for free upgrades, I refuse to pay for 5.0.
If Yazsoft had simply added a line to the receipt way back when I bought the bundle stating that this license was only good for updates through 5.0, I wouldn't have minded this at all, and they would have had my $15 in a heartbeat. But if they went into the bundle sale knowing full well that the apps were advertised as being full licenses, exactly the same as purchasing directly from the developer, and purposely sold licenses under that guise that were anything but full licenses, I cannot entrust my money and goodwill to such a developer.
Yazsoft has lost a customer.

Oh, and might I recommend you make Yazsoft aware of your frustration and distaste for their false advertising practices by posting (in a polite fashion, of course) on their brand-new SD Forums?
Don't go on an absolute flame war, but just politely remind them that they advertised this as a full license, and should have a legal and ethical obligation to treat it as such.
Time Machine got me back, But I'm uninstalling. They've lost a customer and a user.

Hey thats unbelieveble! Where are the MacHeist guys? Whats that? Seems that Bundles like MacHeist are just a way to get customers (for the old crap). Thats so bad :-(
Hey - now you're starting to catch on!
Selling here in bundle deals for insanely low low pricing is being sold to them as marketing that they are paid to participate in - you just have to give out as many licenses as they can sell for the fixed fee you get. Then when you do your next major revision you'll reap the rewards of a larger user base upgrading*.
*provided your app is good , people are happy and you hold up your end of the bargain.
I am not knocking it - it's genius marketing work really on Macheist's part.. I just don't think some developers put a lot of thought into the public relations and user perception - especially if they're doing a major release this soon.

Well, some of us have a little attention in our communities and can do a bit of reputation damage, but I prefer to wait until Directorate speaks up because whatever we bring out in our magazines, blogs etc will indirectly hurt MacHeist too ![]()
