To the MacHeist Community,
We have heard your feedback regarding our recent release of Speed Download 5 and have released an official response on our website. We have thought long and hard about this in order to try and come up with a solution that is both reasonable, feasible, and fair.
We hope you agree and thank you for your understanding.
The link to the response is on our website (found on our buy.html page). There is a note to MacHeist users. The forums here don't seem to allow the posting of a simple url.

PS. For the record, there was never any tactics to force anyone to upgrade. The very first line of the update window clearly says that SD5 is a paid upgrade in bold capital letters. :-)

Well, to put it accurately:

AND, it would have been better to have MADE THIS STATEMENT before and not after purchase. Because anyone, anyone on earth, will tell you that it is better to read everything on a purchase page (meaning the MacHeist bundle page) prior to putting your software there.
ALSO, since it's a special build only for MH buyers, why not DISABLE the automatic update function?
And for yet further clarification, since SD4 is "fully supported", should I expect improvement to it to be in an upcoming version 4.2.x?
Otherwise, why argue about semantics?

Yeah but you knew SD5 was just weeks away from the bundle. You never ever said this was a special non-upgradeable bundle. You stood by as MacHeist advertised and stated on several occasions that the licenses including the bundle are IDENTICAL to the retail licenses of all the programs, as if they were purchased directly from the developer.
YOU KNEW YAZSOFT. YOU KNEW. And now I KNOW I will never do business with you. And every time I talk about software to my friends and colleagues, Illl tell them not to do business with you. And they will hopefully tell their friends and so on.

Well, I look at it this way: I can now use that $15 towards licenses for Journler and Scrivener, two apps which are arguably superior products, by developers with arguably superior customer relations skills to back them up.

I've been around, but I've never seen such slippery wording used in a software vendor's upgrade policy, probably ever. They should consider careers in Federal politics.

I must say Yazsoft's response is long on discussion of semantics without a difference. They knew what MH was advertising. The point here is that bundle buyers were told all apps would be "normal" versions (in the case of SD4 this would mean eligible for free upgrade to SD5 due to their free upgrade policy). They should have corrected this before now is they were only attaching SD4 to MH2. MH advertised SD4 as a full normal version because that was their understanding - which I might say appears to have been understood by all the other developers. Yazsoft can point the finger back at MH, but I just don't see where the problem is anyone's fault but Yazsoft's.
Oh... and I love that they "are going to carry the burden" of allowing MH buyers to upgrade to SD for $15.

Still got the shaft on this, yazsoft. Even with the silly little offer you gave us you're no better than a snake oil salesman. You need to understand that you just shot yourself i the foot by f***ing us all over and you will surely pay for this as it is the worst thing that you could've ever done. You were always on my list of companies to avoid and this solidifies your position towards the top.
Good riddance. I hope no one ever includes your program in a bundle because they know just how much of a lying cheat your company is.

Exactly. They cut their profit in half. It's still a ton of money. Carry the burden and give it to us for free like all the other people who bought it in the grace period.
This whole sad affair reminds me that we need to ensure as end users we do our part to "take care of" the other developers that are treating the community well.
Can you just make "weasels" the official MacHeist word? I doubt anyone would disagree with you.

Yazsoft really needs to hire PR/marketing pros (in house or consultant, whatever) and consult an attorney before doing anything like this again.

The rebuttal on their web says:
"The only difference was the activation mechanism, and this was simply so we can track how many copies were actually sold via the promo. Everything else about the promo SD4 and the regular SD4 were 100% the same."
Then, hello Yazsoft, we purchased within your grace window. MacHeist purchases were from January 9-January 24. Not sure how that doesn't fall within "Users that have registered SD 5 from Jan 01, 2008 to Feb 12, 2008 can upgrade to SD 5 for FREE."
Oh, and you might want to fix that typo (since you are mucking about with so many other things on your site and are so concerned about other site's wording) -- I do believe you mean registered SD4 (that sentence was copied directly from your buy page, Yazsoft).
This has decided it for me. Will be gone from my system, and 1 other that I purchased for and no upgrades paid or otherwise. Time to blog once again about dense people who need to re-read what they themselves have written.
As many have said in the two other threads, I'd have been just fine if any of this had been up front. Or, if you had been aware enough about timing to take your time to improve stability and fix a few bugs in 5.0 with a release the 1st week of March that gave the grace window of Feb 1. Nothing like inflicting bad business judgement on a large quantity of new customers.
And, just for the record. I for one never expected upgrades for life from any developer, let alone one in a bundle deal. Your own policy is what we are expecting you to adhere to. Simple as that.

Cut their profit in half? Since the licenses are not things but a registration for a download there is basically no cost. Then I guess they can change their policy to a true 'user' license like they should have had anyway.
The way i see it they still want their $15 pound of flesh at little cost to themselves (basically tracking serial #s).
They keep pointing at MH when it was they who gave us a lesser 'equal' license. Some licenses are more equal than others, I guess.
Sorry Yazsoft - I do not feel that you have fixed the problem, which is that you promised a full license and didn't deliver. Which, if you had delayed your upgrade by 2 months, or published an interim one, no one would have cared. But the manner in which you claimed MH was at fault, sent a paid upgrade to Sparkle, changed your website multiple times etc - all weaselly actions. Good word.

Glad to say, already have done and will continue to do my part there. Remember to donate, even if it's just $5, for the apps you really do use regularly that are out there basically as freebies. If it's doing the job for you and the developer has a donate button, just do it!

They never addressed the "purchase of a full license in the grace period." It would be a moot issue if they had waited to release SD5 until the MacHeist bundle was well outside that window. THAT is what I feel 90% of the uproar is about.
